These Terms of Service (“Terms”) govern your use of services provided by Infascapes Property Management LLC, doing business as IPM Pools & Patios (“IPM,” “Company,” “we,” “our,” or “us”).

By requesting services, signing a proposal, making payment, or using our website, you agree to these Terms.

IPM provides residential and commercial services including, but not limited to:

• Inground pool design & construction
   
• Patio & hardscape installation
   
• Landscaping & lawn services
   
• Irrigation installation & service
   
• Snow removal & ice management
   
• Power washing
   
• Holiday lighting installation & removal
   
• Property maintenance programs
   

Scope of work will be defined in your written estimate, proposal, or service agreement.

• Estimates are valid for 30 days unless otherwise stated.
   
• Pricing may change due to material cost increases, site condition changes, or client-requested modifications.
   
• Final pricing is governed by the signed proposal.
   

• Deposits are required prior to scheduling most installation projects.
   
• Payment schedules are outlined in your contract or invoice.
   
• Late payments may incur interest at 1.5% per month (or maximum allowed by law).
   
• Failure to pay may result in work stoppage and/or legal action.
   

IPM reserves the right to file mechanic’s liens where applicable under Maryland law.

Any changes to the original scope of work must be approved in writing and may result in additional charges and/or timeline adjustments.

Project timelines are estimates only. Delays may occur due to:

• Weather conditions
   
• Permit delays
   
• Material shortages
   
• Site conditions
   
• Acts of God
   
• Utility conflicts
   
• Client-requested changes
   

IPM is not liable for delays beyond our reasonable control.

Unless otherwise stated in writing:

• IPM will obtain necessary permits for pool and structural installations.
   
• The client is responsible for HOA approvals unless specified.
   
• Inspection delays beyond IPM’s control do not constitute breach of contract.
   

Customer is responsible for:

• Accurate property boundaries
   
• Marking private utilities
   
• Providing clear access to the work area
   
• Removing personal property from work zones
   

IPM is not responsible for damage to unmarked utilities, irrigation lines, invisible fences, or undocumented systems.

IPM is not responsible for unforeseen subsurface conditions including:

• Rock
   
• Groundwater
   
• Unstable soils
   
• Buried debris
   
• Unknown utilities
   

Additional costs may apply if such conditions are encountered.

Manufacturer warranties apply to materials and equipment.

IPM provides workmanship warranties as outlined in your project contract.

Warranties do not cover:

• Normal wear and tear
   
• Lack of maintenance
   
• Improper use
   
• Freeze damage
   
• Chemical imbalance (for pools)
   
• Damage caused by third parties
   

Snow removal services are performed to reduce risk, not eliminate it.

• Slippery conditions may still exist.
   
• Zero tolerance service does not guarantee bare pavement at all times.
   
• IPM is not liable for slip-and-fall incidents unless caused by gross negligence.
   

• Roof access and installation carries inherent risk.
   
• IPM is not responsible for pre-existing roof or gutter damage.
   
• Customer must notify IPM if lights are to remain installed beyond removal schedule.
   

To the fullest extent permitted by law:

IPM’s total liability shall not exceed the amount paid for the specific service giving rise to the claim.

IPM is not liable for:

• Indirect damages
   
• Consequential damages
   
• Loss of business revenue
   
• Loss of use
   

Customer agrees to indemnify and hold harmless IPM from claims arising from:

• Customer negligence
   
• Failure to disclose known site conditions
   
• Unauthorized third-party alterations
   

• Deposits may be non-refundable once materials are ordered.
   
• Custom materials and special orders are non-refundable.
   
• Snow contracts may not be canceled mid-season without written agreement.
   

By using our website:

• You agree not to misuse, copy, or distribute proprietary content.
   
• All logos, branding, images, and marketing materials are property of IPM.
   

These Terms are governed by the laws of the State of Maryland.

Any disputes shall be resolved in Maryland courts unless otherwise agreed in writing.
